摘 要

犯罪中止是一種犯罪停止形態(tài)，在司法實(shí)踐中，犯罪中止不僅存在于單獨(dú)犯罪中，而且存在于共同犯罪中。其中刑法第24條第一款明確規(guī)定了犯罪中止的概念：“在犯罪過(guò)程中，自動(dòng)放棄犯罪或者自動(dòng)有效防止犯罪結(jié)果發(fā)生的，是犯罪中止 。”據(jù)此得出，犯罪中止存在兩種情況：一是未實(shí)行終了的中止，即在犯罪預(yù)備階段或者實(shí)行行為還沒(méi)有實(shí)行終了的犯罪過(guò)程中自動(dòng)放棄犯罪；二是實(shí)行終了的情況下自動(dòng)有效的防止犯罪結(jié)果發(fā)生。本文也將圍繞中止問(wèn)題發(fā)表個(gè)人看法。

ABSTRACT
