摘要
司法解釋是我國(guó)法律體系的重要組成部分。當(dāng)前，它在調(diào)整社會(huì)關(guān)系、指導(dǎo)我國(guó)各級(jí)人民法院審判工作，加強(qiáng)社會(huì)主義法制建設(shè)等方面有著非常重要的作用。隨著我國(guó)社會(huì)經(jīng)濟(jì)的發(fā)展，各種新的社會(huì)關(guān)系不斷涌現(xiàn)，原有的法律不可能預(yù)見(jiàn)及調(diào)整所出現(xiàn)的新的社會(huì)問(wèn)題，而能夠解決這些社會(huì)問(wèn)題的有效途徑之一即司法解釋的運(yùn)用。因此，研究我國(guó)司法解釋問(wèn)題，特別是正確認(rèn)識(shí)和理解我國(guó)司法解釋的合理性問(wèn)題更具有重大意義。
本文共分三大部分。第一部分通過(guò)我國(guó)幾位著名法學(xué)家對(duì)司法解釋的定義以及我國(guó)司法解釋的發(fā)展歷程來(lái)探討我國(guó)司法解釋的特定內(nèi)涵；第二部分通過(guò)對(duì)我國(guó)立法解釋的局限性及法律自身存在的缺陷來(lái)闡述我國(guó)司法解釋的成因；第三部分即本文的重點(diǎn)，通過(guò)司法解釋存在的理論依據(jù)及其巨大的現(xiàn)實(shí)意義來(lái)探討我國(guó)司法解釋的合理性.

Abstract
Judicial interpretation of China's legal system is an important part. At present, the adjustment in social relations, guiding the people's courts at all levels of China's judicial work, strengthening the socialist legal system building and has a very important role. As China's social and economic development, all kinds of new social relations will continue to emerge, the original law can not be foreseen and adjusted by the emergence of new social problems, and these social problems can be solved one of the effective ways is the use of judicial interpretation . Therefore, the study of China's judicial interpretation, in particular a correct understanding of China's judicial interpretation and understanding of the reasonableness of the problem is of great significance.
This paper is divided into three parts. Through the first part of China's leading jurists on several judicial interpretations of the definition of judicial interpretation and China to discuss the development process of China's judicial interpretation of the specific content of the second part by China's legislative and legal interpretation of the limitations of their own shortcomings to elaborate China Judicial interpretation of the causes of the third part of that is the focus of this paper, through judicial interpretation of the theoretical basis and its great practical significance to discuss China's judicial interpretation is reasonable.
