　　[摘要]
　　對(duì)于懲治國(guó)際恐怖主義犯罪而言，其邏輯上的前提是確定這種國(guó)際犯罪的內(nèi)涵。盡管對(duì)于這一犯罪的認(rèn)識(shí)千差萬(wàn)別，但是仍然可以從三個(gè)方面對(duì)其進(jìn)行認(rèn)定：其一，國(guó)際恐怖主義犯罪具有恐怖主義的一般特征，它是帶有政治性的犯罪；其二，該種犯罪是具有國(guó)際性的犯罪；其三，它是明確得到規(guī)定的國(guó)際犯罪，罪刑法定原則對(duì)于國(guó)際恐怖主義犯罪仍然適用。
　　Abstract：
　　As for the punishment on international terrorism crime， the premise is to make certain its connotation. Although various cognitions about this kind of crime， we can still ascertain it from the following aspects： Firstly， international terrorism crime possesses the common character of terrorism， and it is a crime with political nature； Secondly， it is a crime with international nature； Thirdly， it is definitely prescribed， and the principle of “nullum crimen sine lege， nulla ponea sine lege” is applied to this kind of crime.

　　盡管恐怖主義已經(jīng)被認(rèn)為是一種公害，“可以與戰(zhàn)爭(zhēng)、國(guó)家債務(wù)、人口膨脹、饑餓、貿(mào)易逆差、疾病等相提并論”，[1]有人把恐怖主義狂潮稱為“二十世紀(jì)的政治瘟疫”，甚至有人認(rèn)為恐怖主義與政治腐敗、環(huán)境污染一起列為二十一世紀(jì)人類面臨的三大威脅，但是由于恐怖主義問題本身涉及政治、經(jīng)濟(jì)、文化、道德、種族、宗教等多種深層次的因素，也同樣涉及到各國(guó)的不同利益，使得對(duì)于恐怖主義的認(rèn)識(shí)千差萬(wàn)別，莫衷一是。因此，直至今日，國(guó)際上不僅仍然沒有一個(gè)具有全面的、有拘束力的國(guó)際反恐公約，甚至沒有一個(gè)統(tǒng)一的“恐怖主義”的定義。 甚至在同一個(gè)國(guó)家的政府機(jī)構(gòu)里面，對(duì)于恐怖主義的定義也有區(qū)別，例如，“美國(guó)國(guó)務(wù)院對(duì)恐怖主義的定義強(qiáng)調(diào)其政治性動(dòng)機(jī)，而FBI的定義則強(qiáng)調(diào)恐怖暴力的非法性質(zhì)?！?br>
