摘 要
工傷保險制度屬于一種社會性的保障制度，與每個勞動者息息相關(guān)。我國自《工傷保險條例》實施后，對于工傷勞動者的救濟(jì)、康復(fù)以及分散用人單位的工傷風(fēng)險起到很大的效用。但受其本身的摸索試探階段的保守立法傾向以及經(jīng)濟(jì)社會的深化發(fā)展，其弊端越來越明顯，在實踐執(zhí)行過程中也存在許多問題。本文對我國工傷保險制度進(jìn)行分析，以新修訂的《工行保險條例》和《社會保險法》為依據(jù)，參照社會工傷問題，分析我國工傷保險制度的不足之處，并且提出完善工傷保險對策建議。
全文分五個部分：
第一部分，緒論。該部分簡要介紹了我國工傷保險制度背景，研究意義，本文主要內(nèi)容和研究方法。
第二部分，工傷保險概述。該部分介紹了工傷保險相關(guān)定義，同時，介紹了國際工傷保險現(xiàn)狀以及我國香港、臺灣地區(qū)工傷保險發(fā)展?fàn)顩r。
第三部分，我國工傷保險制度存在的問題。文章分別對我國現(xiàn)行工傷保險制度中立法層次低、工傷認(rèn)定爭議多、覆蓋率低、工傷保險與民事侵權(quán)關(guān)系及工傷預(yù)防、康復(fù)問題進(jìn)行深入分析。
第四部分，完善工傷保險相關(guān)建議。該部分對第三部分的問題，提出完善我國工傷保險制度建議。
第五部分，總結(jié)。對我國工傷保險制度發(fā)展現(xiàn)狀和完善進(jìn)行總結(jié)。

ABSTRACT
Employment injury insurance system belongs to a social security system, it’s closely related to each labor. Since the implementation of "Work Injury Insurance Regulations" in our country, it has played a significant role in injured workers relief and rehabilitation and injury risk diversification employer. But influenced by its own model and deep development of economy and society, its shortcomings are becoming more and more obvious. There are many problems in the course of practice. This paper, is aimed at analysis of China's employment injury insurance system, bases on the newly revised "Work Injury Insurance Regulations" and "Social Insurance Law" and with reference to social work injury problems, and puts forward the countermeasures and suggestions to improve the employment injury insurance.
This paper is divided into five parts:
Part One: Introduction. This part briefly introduces the background of employment injury insurance system in China, the research significance, main content and research method in this paper.
Part Two: Overview of employment injury insurance. This part introduces the definition, related injury insurance and employment injury insurance, introduces the current situation of international and China's Hong Kong, Taiwan area of employment injury insurance development.
Part Three: the existing problems of work injury law system in our country. This part mainly analyses the existing problems of our present employment injury insurance system, like as legislative level is low, and more controversy related injuries, low coverage, injury insurance and tort relations and injury prevention, rehabilitation issues, interprets the deep reasons.
Part Four: The suggestions of improving our employment injury insurance law system. Based on the existing problems of our present work injury insurance system, it puts forward sound advice.
Part five：Summary. The development status of China's employment injury insurance system and perfect summary.
