摘 要:
互聯(lián)網(wǎng)技術(shù)的出現(xiàn)和發(fā)展是人類繼工業(yè)革命之后的又一次的信息技術(shù)革命。然而隨著互聯(lián)網(wǎng)技術(shù)的應(yīng)用和發(fā)展,一系列與網(wǎng)絡(luò)有關(guān)的問(wèn)題和糾紛也相伴而生。其中尤以網(wǎng)絡(luò)游戲虛擬財(cái)產(chǎn)的糾紛頻繁發(fā)生。由于在學(xué)理上沒(méi)有明確的分析,在司法實(shí)踐中也沒(méi)有確實(shí)可行的操作方法,使得對(duì)網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的法律保護(hù)成為法律難題。然而為了能夠解決這些隨之而來(lái)糾紛,為權(quán)利人尋求司法救濟(jì),使權(quán)利人的合法權(quán)益得到保護(hù)。在借鑒相關(guān)學(xué)者的研究成果與大量的現(xiàn)實(shí)案例的基礎(chǔ)上,從網(wǎng)絡(luò)游戲的背景、概念、法律特征、以及從物權(quán)的角度著手對(duì)網(wǎng)絡(luò)游戲虛擬財(cái)產(chǎn)權(quán)理論作初步探討研究。通過(guò)分析網(wǎng)絡(luò)游戲糾紛的主體,對(duì)網(wǎng)絡(luò)游戲虛擬財(cái)?shù)南嚓P(guān)的糾紛提出解決方案。

On the Protection of Network Suppositional Possessions
--- on the perspective of virtual property dispute on online game
The emergence and development of Internet technology is a revolution of human in information technology after the industrial revolution . However, along with development of Internet technology, a series of problems and disputes occurred. Especially the virtual property disputes of the online game occur frequently. Since there is no clear theoretical analysis and no practicable method of operation in judicial practice, making the legal protection of virtual property to be a difficulty in law.However in order to be able to solve the dispute followed, for the right to seek the judicial relief, make the rights of the legitimate rights and interests are protected. In reference to related academic research results and on the basis of a lot of real case, from online game concept, the legal characteristics, and the perspective of property right in the virtual property of online game theory,we make a preliminary study . Through the analysis of the main body of the network game disputes, and then propose a plan .
